On January 14, we held the webinar ‘Compliance and Corporate Criminal Liability: From Indictment to Defense: How to Protect the Legal Entity’, organized by Bartolome & Briones and presented by our partner Juan Carlos Lombardía, with the participation of guest criminal lawyer Candela Estévez.

During the session, corporate criminal liability was analyzed, with special focus on criminal defense, addressing the criteria for indictment, the model of self-responsibility based on organisational deficiences, and the role of compliance as a key element for the prevention, mitigation, or exoneration of liability.

The most relevant procedural aspects for the company’s defense were also discussed, such as the burden of proof, the rights of the legal entity, the adoption of precautionary measures and the strategic importance of internal investigations to establish the procedural position and prove the effectiveness of the compliance system.
